Customer Interference & Liability Agreement
1. Booking & Deposit Policy
The Customer can change the date and time of their move with appropriate notice, but the booking deposit is strictly non-refundable under any circumstances.
2. Purpose
The purpose of this agreement is to ensure the safety of the Customer’s belongings, the Company’s staff, and all individuals present during the moving process.
3. Customer Non-Interference
While the Company’s staff are performing moving services, the Customer agrees not to move, carry, handle, or assist with the transportation of items that are being handled by the Company’s staff unless specifically requested or authorized by a Company representative.
4. Interruption of Moving Process
If the Customer, or any person acting on behalf of the Customer (including family members, friends, or other third parties), interferes with, interrupts, or participates in the moving process without authorization, the Customer acknowledges and agrees that such actions may increase the risk of damage or injury.
5. Liability for Damage & Special Waivers
If the Customer or any unauthorized person moves, assists with moving, or interferes with the handling of items while the Company’s staff are performing services, the Customer accepts full responsibility for any loss or damage that may occur to the Customer’s belongings, property, or surrounding premises as a result of such interference. In such cases, Sudan Movers shall not be held liable for any resulting damage.
Structural & Restricted Access Movement: The Company will not assume liability for damages resulting from non-routine moving activities. This includes situations where forced manipulation or hazardous moving operations are necessary due to limited space, navigating crowded work areas, negotiating difficult stairways, moving standing pieces vertically, working near sharp edges, handling items over balconies, maneuvering through tight spaces, working under harsh weather conditions, or at the Customer's request to purposefully damage walls, doors, or frames to accommodate large items.
The Company waives liability and/or damages arising from:
Customer's request to opt out of using moving blankets and/or floor runners.
Customer's request for packing without the use of packing paper.
Customer's request to transport a mattress/box springs without a mattress bag.
Customer's request for the mounting of TV, curtains, shelves, or any item requiring drilling or creating holes and/or dents on the wall or any surface.
Items not under the Company's possession or control.
Contents of boxes, bags, or containers packed by the Customer.
Items not properly prepared by the Customer prior to the move.
Unique or fragile items (including artwork, mirrors, or marble) not professionally packed by the Company.
Furniture with unstable construction.
Furniture disassembled by the Customer (if the Customer disassembles any item themselves, the Customer is solely responsible for reassembling it).
Live Plants & Pots Liability Waiver: Because moving trucks are fully enclosed (for both local and long-distance moves), temperature fluctuations, lack of airflow, or transit movement can cause live plants to wilt, dry out, or break. Sudan Movers accepts ZERO responsibility or liability if any plants or pots wilt, dry up, suffer damage, or break inside the moving truck. Customers are strongly advised to transport live plants in their own personal vehicles; any plants loaded onto the moving truck are transported strictly at the Customer's own risk.
6. TV Mounting, Dismounting & Furniture Assembly
We only unmount TVs when it is safe to do so, and the movers are allowed to refuse if they deem it unsafe. We do not mount TVs at any time. Furthermore, if the Customer elects to disassemble their own furniture, the Customer is strictly responsible for reassembling it at the destination; movers will only reassemble furniture that was disassembled by our crew.
7. Right to Pause or Refuse Service
The Company reserves the right to pause or stop the moving service if Customer interference creates unsafe working conditions or increases the risk of damage or injury.
8. Parking, Driveway & Grass Permission Waiver
The Customer is responsible for ensuring proper, safe, and authorized parking space for the Company’s moving truck as close as reasonably possible to the service location. Parking tickets, fines, or towing fees incurred due to the absence of designated parking spots will be charged to the Customer and added to the invoice.
Driveway & Grass / Lawn Damage Waiver: If the Customer authorizes, requests, or permits the moving truck to pull onto a driveway, or if the moving crew must park on or cross over grass/lawn areas to access the property, Sudan Movers accepts ZERO responsibility or liability for any resulting property or surface damage, including cracked or sunken driveways, asphalt/concrete marks, tire tracks, oil stains, or grass/lawn and landscaping damage.
9. Stairs, Oversized Items, Long Carry & Delays
The Customer is responsible for informing the Company in advance of any stairs, long walking distances, elevator requirements, or building restrictions. Delays caused by elevator waits or long carries may result in additional service charges.
Stair Carry & Oversized Item Surcharges: If any furniture or item does not fit inside the elevator or through the property entrance/hallway and must be carried manually via stairs, additional stair-carry charges will apply based on the floor level and item complexity:
Less than 5 Floors: Additional charge of $200 to $350 (depending on the item and access conditions).
More than 5 Floors: Additional charge of $400 to $600.
10. Mandatory Payment Prior to Drop-Off / Unloading
Payment Policy: The total moving charges, balance, and any applicable service fees must be paid in full BEFORE the moving truck is unloaded / drop-off commences. Acceptable methods of payment are certified cheque, Visa, Credit, Debit, or American Express. If payment is not made in full at the Unloading address, all items will be removed from the truck at the original loading destination, regardless of any non-refundable deposit made.
11. Immediate On-Site Inspection & Verification
Upon drop-off and placement of goods, the Customer is required to thoroughly inspect all items, furniture, and boxes in the presence of the moving staff to confirm condition and verify that nothing is damaged, broken, or missing.
12. Zero Liability After Departure (No Claims Accepted Once Crew Leaves)
Post-Departure Claims Waiver: Once the Sudan Movers crew completes the drop-off and departs / leaves the service location, the Company accepts ZERO liability for any claimed damages, scratches, dents, structural breakages, or missing items. All claims must be made to us on the date of the move and 1 day after unloading. The Customer must provide damage furniture invoices for any claims. No damage, scratch, or missing item claims will be accepted or processed after this period.
13. Standard Cargo Protection & Insurance Coverage ($1.20 / lb)
Valuation Coverage Limit: Sudan Movers provides standard released valuation cargo protection coverage up to a maximum rate of $1.20 per lb (pound) per damaged or lost article. This coverage applies strictly to items that were professionally wrapped, blanketed, and handled exclusively by Sudan Movers personnel. Any goods where furniture wrapping was waived, customer-packed boxes, or claims submitted after the moving crew has departed the premises are completely excluded from this coverage.
Example Calculation: If a damaged item weighs 20 lbs, the maximum claim payable is 20 lbs × $1.20 = $24.00. Compensation is strictly based on the actual weight of the item multiplied by $1.20/lb, not the original retail purchase price or market replacement value.
14. Agreement Conflict
In the event of any conflict between this agreement and other service contracts signed by the Company and the Customer, the terms of this agreement shall prevail.
Binding Acknowledgment & Release of Claims:
"By signing below, the Customer acknowledges that they have read, understood, and agree to all terms of this agreement, including: (1) Non-refundable deposit policy, (2) Full payment before unloading/drop-off, (3) Mandatory on-site inspection of all items, (4) Standard cargo insurance coverage limited strictly to $1.20 per lb, and (5) Full release of Sudan Movers from any liability, scratch, damage, or missing item claims once the moving crew departs the premises."
